Medical negligence is referred to as clinical negligence. This covers the treatment you receive from all medical professionals, general practitioners, dentists, orthopaedic surgeons, psychologists, psychiatrists, physiotherapists, etc.
When the standard of the treatment falls below the standard considered as reasonable for the medical professional’s experience, the professional is negligent if this causes you injury and losses.
The treatment can include not treating you correctly, failure to diagnose symptoms, injuring you during an operation, a delay in diagnosis etc.
If you have suffered this then you will be entitled to claim compensation from the medical professional.

WHAT YOU MUST DO
In a claim it is for you to prove that there has been a breach of duty and this caused you to suffer injury and loss so that we can establish a compensation claim on your behalf.
BREACH OF DUTY
You have to prove the medical professional failed to do something or they did something which no other reasonably competent medical professional with their similar specialism would have done or failed to do so. We refer to this as liability.
If you establish a breach of duty then you have to show this caused your injury. It is for you to show the correct standard of care was not afforded to you by the clinician.
